Pakistan’s Islamic Court Rules Women Seeking Khula Should Return Haq Mehr to Husbands

As per recent news, the Federal Shariat Court (FSC) has ordered that Muslim women seeking Khula (divorce) from their husbands must return the Haq Mehr money they got when they married.

The petitions was submitted by four men against their former wives were heard by a three-member bench led by FSC Chief Justice Muhammad Noor Meskanzai and comprised of Justice Dr Syed Muhammad Anwar and Justice Khadim Hussain M Sheikh.

At the time of their marriage, a man pays his wife Haq Mehr in the form of cash or any other valuable thing.

The Sharia court has declared the 2015 amendments to the 1964 Family Law, Section X and Sub Sections V and VI, invalid and void, requiring women to return the entire amount of Haq Mehr to their husbands after Khula.
