Unmarried Daughters to Be Given Pension After Parents Death: Supreme Court

The Supreme Court ruled that an unmarried daughter is entitled to both her father’s and mother’s family pensions after their deaths.

The case was heard by a two-judge bench of the Supreme Court, consisting of Justice Manzoor Ahmad Malik and Justice Syed Mansoor Ali Shah.

“The right to a pension is essential from a constitutional standpoint. It is founded on Article 9 of the Constitution, which guarantees the right to life and livelihood. It is critical to recognize that both the respondent’s parents (unmarried daughter) dedicated the best years of their lives to government service in the hopes of receiving a pension upon retirement and leaving a family pension for their children upon their death, according to the lawful provisions. Depriving the children of civil servants of their family pension based on an illegal and unconstitutional clarification by the Punjab Finance Department violates the right to dignity of the deceased civil servants, who were promised under the law that they and their children will enjoy the protection of a pension upon retirement,” Justice Shah wrote a six-page judgment.
