Court Rules Monal Restaurant’s Demolition Was Illegal

The Federal Constitutional Court (FCC) has set aside an earlier order that directed the demolition of Monal Restaurant at Pir Sohawa. The decision came after the court accepted appeals filed by the Capital Development Authority (CDA) and the Metropolitan Corporation.

With the latest ruling, the court has sent the ownership dispute back to the relevant trial courts. These courts have been instructed to hear the pending cases independently and decide them as quickly as possible according to the law.

The FCC also clarified that administrative and regulatory matters related to the case should be handled by the appropriate government authorities. The court emphasized that each institution should perform its responsibilities within the limits of its legal authority.

During the hearing, the bench stated that its decision was based entirely on legal principles and a detailed examination of the case record. The judges said the ruling was made after carefully reviewing the facts, legal arguments, and relevant laws presented before the court.

The decision means that the legal dispute over the property will continue in the trial courts, where all parties will have the opportunity to present their evidence and arguments. The trial courts will now determine the ownership and other legal issues related to the matter.

The case has attracted public attention because Monal Restaurant has long been a well-known destination for visitors to Pir Sohawa. The latest ruling does not bring the dispute to an end but instead allows the legal process to continue through the proper judicial channels.

Legal experts say the decision highlights the importance of following due process and ensuring that property disputes are decided by the appropriate courts. Authorities are expected to follow the court’s directions while the ownership case proceeds under the supervision of the relevant trial courts.
