Chief Justice Advises Government to Refrain from being Aggressive

Chief Justice Umar Ata Bandial advised the federal government to refrain from being aggressive and said that everyone has to play a positive role as the situation has reached.

A three-member bench headed by Chief Justice of Pakistan (CJP) Umar Ata Bandial heard the review petition filed by the Election Commission of Pakistan (ECP). During this time, the Chief Justice told the Attorney General that aggressiveness does not help anyone, avoid it.

The Attorney General told the court that the Supreme Court Review Act has now become a law, now the review appeal will be heard by a larger bench than the bench giving the decision and under the new Act, the jurisdiction of review will be the same as the appeal.

Chief Justice Umar Ata Bandial said that this has become a very interesting matter, this court also looks at the fundamental right of independence of the judiciary, you take instructions from the government in this regard.

The Chief Justice remarked that the court will sit in the second case on Thursday, we want the other party to know about this law, the Chief Justice inquired that the other party is aware of this new law. The Attorney General said that Ali Zafar was not seen today but he must have come to know from the Senate.

Chief Justice Umar Ata Bandial said that the court’s mind is not to abolish any law, now why should we break this law, only protect the independence of the judiciary. The court reform case will be heard on Thursday.

The Chief Justice said that the chief justice’s nominees were included in all the commissions that were formed, do not abolish judicial traditions. Matters should not be kept secret, you had reservations about the Chief Justice, call it an accident of history, but the Chief Justice is the same.
In the past, the Chief Justice used to nominate a judge for the commission and after the nomination of the judge, the government used to notify them. Try to adopt the right behavior. Later, the hearing on the review petition of the Election Commission was adjourned.
