State Can Acquire Private Land for Public Use with Fair Compensation to Owner: Supreme Court

Pakistan’s Supreme Court has ruled that the government cannot acquire private land without providing fair and just compensation to landowners, reinforcing constitutional protections for property rights.

The court directed that compensation must reflect the land’s actual market value, considering inflation, rising property prices, and future development potential rather than relying on outdated official valuation rates.

It also warned authorities against delaying land acquisition or compensation payments, stating that such practices unfairly burden citizens. The judgment emphasized that while land may be acquired for public projects, the rights of property owners must be safeguarded, and courts are responsible for ensuring justice in every case.
